Spectator's Handbook

1.1 - What is it?

The Spectator's Handbook is the document that brings together the Terms and Conditions for participation in Events (see definition of Event), as well as a set of useful information for the Spectator (see definition of Spectator) who intends to participate.

1.1.1

With the purchase of the Event Admission Ticket (see definition of Admission Ticket/Ticket) and in any case with the access to the Event Venue (see definition of Event Venue), the Spectator is obliged to comply with the Terms and Conditions of Participation contained in this Manual, which he/she is invited to consult whenever he/she intends to attend an Event.

1.1.2

The Terms and Conditions of the Manual will be constantly revised in order to be constantly updated according to changing situations, the needs related to the realisation of the Event and the needs expressed by the Spectators themselves.

1.1.3

The provisions of this Manual apply in addition to the terms and conditions of the Sales Circuits (online and offline) authorised to sell tickets (see Sections 2.2.1 and 2.3.2) and in addition to the terms and conditions governing access to and use of the Event Venue.

1.2 - How is it used?

In order to simplify consultation of the Spectator's Handbook, we have identified the general topics around which Spectator's questions revolve and provided the answers in the form of FAQ(s).

2.1 - Do I need an Admission Ticket to attend the Event?

2.1.1

Yes, all Spectators must be in possession of a valid Admission Ticket to the Event Venue and are required to retain it until the conclusion of the Event.

2.1.2

A spectator who is found without a ticket must pay the full ticket price again.

2.1.3

The admission ticket purchased or received as a gift may not be transferred for consideration (not even for the same price), nor may it be brokered.

2.1.4

The purchased ticket is valid in a single copy and may not be reproduced in any form (photocopy, scan, etc.), nor may it be transferred to third parties. The procedures and conditions for the correct use of the purchased ticket are published on the website of the sales circuit and must be complied with in their entirety.

2.1.5

According to the ticketing policy of Cave del Duca: "It is forbidden to use the tickets for commercial activities, promotions, fund-raising, auctions, sweepstakes, lotteries, associated with/sold with packages of goods or services of any activity similar to those described, even if not commercial. Furthermore, it is strictly forbidden to resell the tickets to third parties by any means whatsoever, and in particular, to offer them to the public through online platforms/sites, also pursuant to art. 1 paragraph 545, L. 232/2016", in the absence of specific agreement and prior written authorisation by Cave del Duca.

2.2 - Where to buy tickets for the Event?

2.2.1

Cave del Duca does not directly deal with the sale of tickets to the final consumer, but uses authorised sales circuits indicated in the Event Calendars section of this site.

2.2.2

Cave del Duca disclaims all liability in the event of tickets being purchased from parties and/or sales circuits other than those indicated in the previous point and therefore not authorised for sale.

2.2.3

In the event that, during checks, the Admission Ticket is purchased outside the official sales circuit and/or other authorised sales circuits, or is purchased and then lost, stolen, duplicated or obtained contrary to the provisions of this Manual, Cave del Duca reserves the right to prohibit access to the Event Venue and/or to expel from the Event Venue the bearer of the ticket deemed to be irregular or missing.

2.3 - Who can I ask about tickets?

2.3.1

For requests or questions regarding payment, shipping, collection methods, seat selection and any other information regarding the ticket, the spectator is invited to contact the official sales circuit that issued the ticket directly, since Cave del Duca cannot directly intervene in the business procedures of the individual circuits. For all other questions please read the following points.

2.3.2

All ticketing circuits have their own terms and conditions governing the sale of tickets by their respective channels (see point 1.1.3). The Spectator is invited to carefully consult the terms and conditions of sale of the sales circuits, whenever they intend to purchase tickets to attend an Event.

2.4 - I forgot/lost/damaged my ticket, can I attend the Event?

2.4.1

No, in order to attend the Event all Spectators must have a valid ticket and are required to keep it until the end of the Event.

2.5 - I have the wrong day of the concert, but I have a ticket for the Event the day before or after, can I attend the Event?

2.5.1

No, even in the case of two or more dates close to each other, the ticket is valid and constitutes Admission Pass for the Event, day and time indicated on the ticket only.

2.6 - I have noticed that price reductions or promotions are applied for some Events. Do they apply to all Events?

2.6.1

No, Cave del Duca reserves the right, for particular Events or, in any case, at its own discretion, to put on sale tickets at reduced prices, special promotions for groups of people and, in some cases, reduced fares for children, over 65s, people with disabilities, etc. In all the aforementioned cases, the sale of tickets shall be understood as "AS AVAILABLE", given that Cave del Duca will dedicate an adequate, but always limited number of tickets to such promotional initiatives.

2.6.2

In the case of tickets purchased at a reduced price or on promotion, or of free gifts or nominative tickets, Cave del Duca reserves the right, at its discretion, also through its staff (control, assistance and/or security personnel), to ask the Spectator, at any time, to show a valid identity document, in addition to the valid Admission Ticket. The examination of the Spectator's identity document is aimed, in particular, at verifying the existence of the requisites required for the purchase of the specific Admission Ticket exhibited (e.g. age) and the correspondence between the identity of the Spectator and the Admission Ticket exhibited. In the event of a negative outcome of the verification, Cave del Duca may, at its own discretion, and without owing anything to the Spectator for any reason or cause whatsoever, prohibit access to the Event Venue and/or expel the irregular ticket holder from the Event Venue, as well as it may demand payment of the difference between the price of the full ticket and the price of the ticket purchased at a reduced price or on promotion.

2.7 - Are tickets named?

2.7.1

The 2019 Budget Law (L. 145 of 30.12.2018, Art. 1, paragraph 1100) introduced with effect from 1 July 2019 the obligation of nominal tickets for shows of "contemporary popular music" - i.e. pop, rock, rap, metal, dance, jazz folk and others - in venues with a capacity of more than 5,000 people and clearly displaying the name and surname of the person using the ticket. The obligation concerns all tickets purchased by any means (online and point of sale), complimentary tickets and tickets issued directly by the Organiser even at the cash desk on the day of the show. The name and surname of the user of the ticket must be entered at the time of purchase (an identity document is not required at the time of purchase); in the case of the purchase of several tickets, the name and surname of the respective user must be entered on each ticket. The regulations provide for the possibility of changing the name of the purchased ticket, but it is up to the Organiser to establish the time interval (from when and until when) within which to request the name change from the primary service provider (authorised ticketing circuit - online and/or point of sale), who will make the change by charging a service fee. Regardless of the capacity of the Event, Free Entrance Tickets are always issued in the name of the user, and in some cases the user's date of birth may also be requested. In the event of entry with a nominative Entitlement (paid and/or complimentary), the Spectator - including minors - must always be in possession of a valid identity document to be shown to the staff appointed by Cave del Duca for surveillance and access control (see Art. 1 - paragraph 545-ter, Law 232/2016): access to the Venue hosting the Event is allowed only after personal recognition, through verification systems of the participants, including minors. In the event of data mismatch or if a Spectator is not in possession of an original identification document (photocopies or scans are not allowed), the Entrance Ticket loses its validity and is cancelled without any refund.

2.7.2

In the event of entry with a nominative Ticket, Spectators in possession of an Entrance Ticket in the name of another person will not be allowed access to the Event Venue. Where foreseen, it will be possible to change the user of the ticket, following the instructions that Cave del Duca will publish on its website and on the website of the ticketing circuit. The change of user may not be envisaged for complimentary tickets, the transfer or passing of which is strictly forbidden.

2.8 - Tickets on one sales circuit are sold out, while on another sales circuit they are available. Is this possible?

2.8.1

Yes, this is possible. Cave del Duca, at its discretion, may also distribute the Event's Admission Tickets through additional and different sale circuits, therefore, it may happen that, when the Spectator makes the purchase from one of the authorised circuits, the latter may not have the availability of all types of tickets on sale. Since the allocation of Entry Tickets to the sale circuits takes place in several instalments and at different times from the opening of pre-sales up to the day of the Event, the Spectator chooses and purchases the ticket for which the circuit has availability at the time when the sale transaction is concluded. The availability of Admission Tickets allocated to each sales circuit may vary in the period from the opening of pre-sales to the date of the Event.

2.8.2

It is also possible that, following the production's final checks, an additional limited number of tickets may become available, therefore, even in the event of an Event that is initially unavailable/sold out, Cave del Duca may, at its own discretion and at any time, put additional seats of any order or category of the Event on sale. In order to be considered valid, the ticket must be: original (not a photocopy), intact, legible in all its parts and must have been purchased at an authorised sales circuit (see point 2.2.1) or must be a complimentary ticket issued by Cave del Duca.

2.9 - I bought a ticket at a point of sale and paid a higher price than the one indicated on your website. Is this possible?

2.9.1

Yes, it is possible, but it is not fair; on the contrary, it is symptomatic of misconduct on the part of the point of sale (cf. 2.12.3) and the Spectator shall promptly report it to Cave del Duca.

2.10 - What should I do if my ticket is lost, damaged or stolen?

2.10.1

In the event of lost, damaged or stolen tickets, the spectator wishing to attend the Event must purchase a new ticket (subject to availability), in fact, it is NOT possible to → ask for the duplication or reissue of the ticket already issued and subsequently lost, damaged, become partially illegible or stolen; → ask for the replacement of the lost, damaged, become partially illegible or stolen ticket with a ticket of the same Event or of a different Event; → attend the Event (unless a new ticket is purchased, if available); → ask for the refund of the price paid for the purchase of the lost, damaged, become partially illegible or stolen ticket.

2.10.2

The person who purchased the ticket, which is subsequently lost or stolen, shall report the fact to the Judicial Authority, indicating the ticket's identification elements (date and place of the concert, seat, etc.). The copy of the report of theft or loss must be sent promptly (Pec/e-mail/fax/fax/r or registered mail by hand) to Cave del Duca and to the authorized sales network where the ticket has been purchased, in order to allow Cave del Duca to prevent access to the Event Venue to those who have entered in possession of the ticket in a fraudulent or irregular manner. Please note: under no circumstances can the copy of the complaint replace the Admission Ticket and, therefore, cannot allow access and participation in the Event.

2.11 - I have arrived/entered the venue: my ticket does not pass the access control or I realise I have a ticket for a seat that is already occupied, what should I do?

2.11.1

For reasons not attributable to Cave del Duca, it is possible that a ticket duly purchased from one of the authorised sales circuits has been cancelled by the circuit itself and does not pass the access control at the entrance to the venue. The cancellation may have been caused by an error in the system managed autonomously by the sales circuit with the consequence that for Cave del Duca that ticket is not valid and has not been paid for. In such an eventuality, the Spectator is required to purchase a new Ticket, subject to availability, at the Event's ticket office. With the new ticket purchased on the evening of the Event, the Spectator will be able to regularly access the venue and attend the Event, without prejudice to the right to activate the procedure for the refund of the cancelled ticket, by directly contacting the sales network where the ticket was purchased.

2.11.2

In the event that the ticket passes the access control, but the Spectator finds his/her seat occupied by another person holding a ticket with an identical sector and seat, he/she shall immediately contact the Cave del Duca personnel present inside the venue, asking them to verify who has the right to occupy that seat. The Cave del Duca personnel in charge will verify who has the right to occupy that seat and will take care of accommodating the Spectator with an identical ticket elsewhere, unless they ascertain the irregularity of one of the two Admission Tickets (forged or duplicated or cancelled ticket).

2.11.3

The Spectator forfeits any right to occupy the seat or to make claims for reimbursement, compensation or damages in general, if he or she does not report the above, strictly by the starting time of the Event.

2.12 - What is secondary ticketing, what are the risks and how to combat it?

2.12.1

This is a parallel to the authorised ticket market, strongly active on the Internet, offering tickets for all kinds of events for sale, not only in the music industry. Some Internet sites sell unauthorised tickets that are unjustifiably overpriced by multiples of the official price, fuelling a veritable illicit parallel market to the detriment of the consumer (Spectator), which must be reported and denounced to the Judicial Authorities.

2.12.2

Cave del Duca invites the Spectator to verify for each Event, before purchasing tickets, which are the authorised sales circuits, and not to purchase tickets outside the circuits indicated as authorised/official (see 2.2.1). A Spectator who decides to purchase from unauthorised sites or unofficial channels assumes the high risk of incurring overpriced, fake and invalid tickets, and furthermore fuels the age-old scourge of secondary ticketing, which creates great inconvenience for the public and live music.

2.12.3

The spectator should be aware that no commissions, agency fees or other additional costs may be charged on the ticket price, as indicated on the ticket itself (with the exception of presale fees, which are indicated on the ticket itself).

2.12.4

Cave del Duca reserves the right to deny entry to the Event to ticket holders who, in its unquestionable judgement, will be considered to have come from unauthorised or otherwise irregular retailers and the holder of the irregular ticket may be reported to the competent Authorities for incautious purchase or fraud to the detriment of the official sales circuit and Cave del Duca. Please note that the law punishes manufacturers and sellers of fake tickets.

2.13 - How do I know if I am buying a ticket from an authorised retailer?

2.13.1

The number of sites or sales outlets that are not authorised to sell tickets is constantly increasing, therefore, Cave del Duca undertakes to keep the following list of unauthorised ticket sellers (the "black list") constantly updated and invites Spectators to consult it whenever they intend to participate in an Event, reporting any kind of abuse.

3.1 - Can children attend the Event?

3.1.1

For safety reasons and to protect the physical safety of the child, Cave del Duca has decided, at its discretion, to prohibit children under 12 months of age from entering the Event, and in any case, Cave del Duca strongly advises against bringing children under 4 years of age to the Event. The entrance to the Event Venue of children under the age of 4 years is considered to be at the full risk of the parents or persons exercising parental authority over the minors, without any liability on the part of Cave del Duca.

3.1.2

The access modalities for children will be indicated by Cave del Duca for each Event and can be consulted at the time of purchasing tickets on the websites of the sales circuits or on the website dedicated to the single Event. The Spectator is therefore invited to check the access procedures for children before purchasing the Event's Ticket and before going to the venue where the Event takes place.

3.1.3

It is compulsory for children to wear ear muffs or other ear protection.

3.2 - Do children pay for a ticket?

3.2.1

Without prejudice to the provisions of point 3.1.1 and provided that the admission of children under the age of 4 is not expressly prohibited by the venue regulations, children under the age of 4 accompanied by an adult (adult) with a regular admission ticket attend the Event in the number of one child per accompanying adult. If the adult has a ticket for a sector with numbered seats, the child is NOT entitled to occupy a seat and must necessarily be carried (under no circumstances are prams, pushchairs, baby carriers and similar equipment allowed inside the Event Venue). In sectors with Unnumbered Standing Seats, such as e.g. the standing area in a stadium or the standing parterre in a sports hall (see definition of Unnumbered Standing Seats), the child may be seated or in any case next to the accompanying adult. In sectors with unnumbered seats, e.g. unnumbered tiers or unnumbered ringside, the child may stand next to the accompanying adult and may occupy an unnumbered seat if provided.

3.2.2

Admission of children from 4 years of age (on the date of the Event) is regulated by Cave del Duca according to the venue, based on objective criteria of the division of the sectors (seated and standing) and on the basis of the venue's access regulations. With the exception of what is stipulated below, children aged 4 and over pay the full ticket price.

3.2.3

Cave del Duca, at its discretion, may reserve special promotions for FAMILIES or sell tickets at reduced rates for children, subject to availability (see point 2.6). When purchasing a reduced children's ticket, a valid identity document certifying the age of the child for whom the ticket is being purchased must be shown. In the absence of a document proving the age of the child, payment of the full ticket will be required. Should the child for whom the reduced ticket was purchased turn out to be older than the age required to benefit from the price reduction, Cave del Duca reserves the right to demand payment of the difference between the price of the reduced ticket and the full price.

3.3 - I have purchased a ticket for one of your concerts and I am a minor. Do I have to be accompanied by an adult?

3.3.1

All minors up to and including 16 years of age must attend the Event accompanied by an adult with a valid entry ticket, at a ratio of one adult for every two minors. Admission to the venue and to the Event of a minor unaccompanied by an adult is at the full risk of the minor's parents or persons exercising parental authority over the minor. Cave del Duca declines all responsibility in the event of minors entering the venue and attending the Event without an adult accompanying them.

4.1 - Can pregnant women attend the Event?

4.1.1

On the occasion of certain Events and for reasons of safety and physical safety, Cave del Duca reserves the right, at its sole discretion, especially where standing room only and/or not numbered seats are provided, not to allow access to the venue and participation in the Event to women who are over 36 weeks pregnant, even if in possession of a regular Admission Ticket, at any time purchased.

4.1.2

If there is a choice between standing and seated seats, Cave del Duca recommends the purchase of a seated ticket and points out that, whatever type of Event is organised, there will be no areas dedicated to pregnant women, no preferential entrances or special assistance services and they will not be allowed access to the area reserved for disabled people. In any case, pregnant women who decide to attend the Event do so at their sole risk, without any liability on the part of Cave del Duca.

4.1.3

In the event of pregnancy occurring or discovered after the date of purchase of the ticket and up to the date of the Event, the replacement or refund of the purchased ticket is not permitted, nor can the claim be made to be placed within the venue in a different seat from the one indicated on the purchased ticket.

4.2 - Can injured persons attend the Event?

4.2.1

For safety reasons and in order to protect their own physical safety and that of other spectators, Cave del Duca does not recommend attending the Event to injured persons and those who are in plaster or otherwise obliged to wear braces, knee pads, ankle braces, crutches and walking aids in general, etc.

4.2.2

For injured persons and those in plaster or otherwise obliged to wear braces, knee braces, ankle braces, crutches and walking aids in general, etc., the same conditions apply as for pregnant women (cf. points 4.1.1 to 4.1.3).

5.1 - What are the conditions of participation in the Event for the disabled?

5.1.1

In compliance with current fire prevention regulations in entertainment and public Event venues (cf. definition of "Quiet Space", Ministerial Decree of 19 August 1996), for reasons of safety and accessibility, persons with disabilities are reserved specific and limited places within the Event Venue, suitable for the special needs of wheelchairs and persons with reduced or impeded mobility. For each Event, the Organiser reserves an adequate, but necessarily limited, number of places for persons with disabilities and their accompanying persons (who must be of age).

5.1.2

The ordinary ticket alone does not allow wheelchair users to enter the venue, therefore it is emphasised that the regular purchase of any admission ticket does not allow access to the Event Venue.

5.1.3

To access the Event, persons with disabilities must book a ticket for the area reserved for them, through the procedure described below.

5.2 - What is the ticket booking procedure for persons with disabilities?

5.2.1

A disabled person, with the right to an accompaniment and in need of continuous assistance, who wishes to attend the Event, must compulsorily reserve a place in the reserved area, making a request to the Organiser to purchase the relevant ticket. The reservation request must be sent by email to the address info@cavedelduca.it. All requests received before the sales opening date for the Event requested will not be considered.

5.2.2

Where it is not possible to use the Booking Form or email for persons with disabilities, prepared by the Organiser, the booking request must contain: an indication of the date of the Event you wish to attend, consent to the processing of personal data, expressed by signing the following declaration: "I authorise the processing of my personal and sensitive data, included in the booking request for tickets for the admission of persons with disabilities to the above-mentioned Event, pursuant to Legislative Decree 30 June 2003, no. 196 'Personal Data Protection Code' and the GDPR (EU Regulation 2016/679)".

5.3 - What are the criteria for allocating places to persons with disabilities?

5.3.1

The sending of a booking request does not entitle the participant to participate in the Event if it is not confirmed by the Organiser within 30 days prior to the date of the Event. In the event of availability of seats for the requested date, the Organiser shall confirm the booking in writing and provide all relevant information on payment and how to collect the tickets. In the event of non-confirmation, the request shall be considered to have been rejected due to the exhaustion of available seats.

5.3.2

Seats will be allocated (subject to availability), with priority being given to the highest disabilities with the right to accompaniment and continuous assistance, duly certified, according to the date of arrival of the ticket reservation request (where the percentage of disability is equal, the request received first is preferred).

5.3.3

What is the ticket price for admission of persons with disabilities? The price of the ticket reserved for persons with disabilities, for whom a seat reservation request has been confirmed, is set by the Organiser at the lowest price on sale. Payment of the price reserved for a person with a disability will allow the collection of a ticket for the person with a disability and a free ticket for the accompanying person, who must be over 18 years of age. Only one accompanying person per disabled person is admitted.

6.1 - Can the Event be postponed?

6.1.1

Yes, the Organiser reserves the right to change the venue and/or the date and/or the time of the Event for technical-organisational reasons and, in any case, for reasons dependent on the Artist's will and/or unforeseen needs: the Spectator is invited to constantly check on the website and on the ticketing circuit website that the Event has not been changed.

6.1.2

In the event of postponement of the Event (place/date/time), to be understood as postponement of the Event to a date within 90 (ninety) days from the date indicated on the ticket purchased, the Ticket may be reused for the new date and the Ticket holder is required to retain it. The new date, the new time and the new venue, as well as all the necessary information, will be published on the website and on the website of the ticketing circuit, which the Spectator is required to consult.

6.1.3

With particular regard to the postponement of the timetable, it should be noted that the Organiser reserves the right to change the start or end time of the Event. In the event that the Event time is changed, but the Event is performed and completed on the same day, there shall be no replacement of the ticket, no refund of the price or any other form of indemnity/compensation.

6.2 - Can I request a refund for a postponed event? Where and how to do this?

6.2.1

Information on whether or not the right to reimbursement is recognised and the procedure for requesting it will be published on the website and on the website of the ticketing circuit, which the Spectator is required to consult.

6.2.2

Where reimbursement is provided, the spectator shall address the relative request to the sales outlet or sales circuit where the ticket was purchased, in accordance with the procedures and within the time limits established by the Organiser for each postponed Event. In no case may the request for reimbursement be addressed directly to the Organiser, who is not obliged to acknowledge it.

6.2.3

Where reimbursement is envisaged, the Spectator may only request the ticket price, while costs incurred for: service fees; insurance coverage premium; shipping costs; cost of gift wrapping, air/rail/board and lodging, hotel and any other and different expenses incurred by the Spectator in connection with participation in the postponed Event shall be excluded from reimbursement and shall not be recognised.

6.2.4

Under no circumstances may the Organiser be held liable for the postponement of the Event and no financial claim may be made against it for compensation/reimbursement/indemnity for damages or any expenses of any kind and nature whatsoever incurred as a result of the postponement of the Event.

6.3 - Can the Event be cancelled?

6.3.1

Yes, the Organiser reserves the right to cancel the Event at any time for technical-organisational reasons and, in any case, due to the Artist's unforeseen needs: the Spectator is invited to constantly check on the Organiser's website and on the ticketing circuit's website that the Event has not been cancelled.

6.3.2

The Event is also deemed cancelled when it is rescheduled for a date later than 90 (ninety) days from the date indicated on the ticket. In this case, the ticket must necessarily be cancelled and may no longer be used. As a rule, in order to attend the Event on the new date, the Spectator must purchase a new ticket.

6.4 - Can I request a refund for a cancelled event? Where and how to do this?

6.4.1

Yes, information regarding the procedure for requesting a refund will be published on the website and on the ticketing circuit's website, which the Spectator is required to consult. For this reason, the Ticket Holder is always required to check the procedures and timeframes for requesting a refund, as established from time to time for each cancelled Event. The Spectator is also obliged to keep and exhibit upon request the ticket for which they intend to request reimbursement.

6.4.2

As a general rule, the spectator must address the relative request to the sales outlet or sales circuit where the ticket was purchased, in accordance with the procedures and within the deadlines established from time to time by the Organiser for each postponed Event. It should be noted that in indicating the deadline for requesting reimbursement, the Organiser shall comply with the deadline imposed by current legislation for the payment of VAT, i.e. the 16th day of the month following the date of the cancelled Event. In no case may the request for reimbursement be addressed directly to the Organiser, who is not obliged to acknowledge it.

6.4.3

With the reimbursement, the Spectator may only claim the ticket price, while costs incurred for: service fees; insurance coverage premium; shipping costs; cost of gift wrapping and any further and different expenses incurred by the Spectator in connection with participation in the postponed Event shall be excluded from the reimbursement and shall not be recognised.

6.4.4

Under no circumstances may the Organiser be held liable for the cancellation of the Event and no financial claim may be made against it for compensation/reimbursement/indemnity for damages or any expenses of any kind and nature whatsoever incurred as a result of the cancellation of the Event.

6.5 - What happens in case of rain or bad weather?

6.5.1

As a rule, Outdoor Events are held even in the event of rain or bad weather. Should the execution of the Event prove to be risky for the safety of persons or property, due to adverse weather conditions, the Organiser, at its sole discretion, may interrupt the performance.

6.5.2

The Event is deemed to have been performed when it lasted 45 minutes or more (even if not consecutive) from its commencement (time indicated on the ticket) to its conclusion.

6.5.3

In the event of an interruption of the Event due to adverse weather conditions, there shall be no refund of the ticket price or any other form of compensation/reimbursement when its duration was 45 minutes or more from the beginning to the interruption.

6.5.4

The Spectator is invited to verify whether or not he/she has the right to reimbursement and the relative application methods and timeframe, by consulting the website or the TicketOne circuit or other ticketing circuits (2.2.1), it being understood that the request for reimbursement - where applicable - must always be addressed to the sales circuit that issued the ticket.

7.1 - Can the Spectator renounce the Event?

7.1.1

After the purchase of a ticket, howsoever finalised (including electronically), a Spectator who decides not to participate in the Event or is prevented from doing so, shall not be entitled to a refund of the ticket price, nor of any additional fees and charges.

7.1.2

The right of withdrawal from contracts for the provision of leisure services is in fact excluded by art. 7 - letter b. of Legislative Decree 22 May 1999, no. 185, implementing EEC Directive 97/7/EC, as well as by art. 59, letter n) of the Consumer Code. This is without prejudice to the Spectator's right to take out an insurance policy sold by the ticketing circuits.

7.1.3

Under no circumstances will it be permitted to request the replacement of a ticket purchased for a relinquished Event with another ticket for an Event that is different in terms of date, place, type of seat.

8.1 - Sales have been opened, can the event configuration be changed? (Moving the stage and seats)

8.1.1

Yes, this is possible. For technical-organisational reasons or for requirements linked to the production of the event or for artistic needs, Cave del Duca and the Organisers of the event in question reserve the right to modify, at any time and at their discretion, even in the case of a sold-out event, the configuration of the event, move the stage, change its shape and size, modify the layout of the seats already sold out and reallocate them in other sectors within the venue, even if different from those indicated on the admission tickets. In such cases, Cave del Duca will provide adequate and timely information on the new configuration of the event and the location of the new seats. Please note that the map published on the sales website (intended as the position of the seats, of the stage and of the catwalk, if any) is to be intended merely as an indication, not to scale and not binding for the Organiser.

8.2 - What objects are prohibited inside the Event Venue?

8.2.1

It is forbidden to bring inside the Event Venue illicit, prohibited and/or dangerous materials for one's own safety or for the safety of third parties, such as: bottles, cans or containers made of glass or any other material (drinks must be poured into plastic or paper cups), pointed umbrellas, selfie sticks, helmets, sticks, powerbanks, cameras (e.g. Reflex cameras) or video cameras, soiling or polluting materials and any other object, even if abstractly likely to offend in relation to the circumstances of time and place, or that the Police present deem forbidden. Entrance ticket/ticket:
This is the document, also in digital format, issued by the sales circuit, which legitimises the Spectator's access to the Event Venue. The purchase of the Admission Ticket can be made electronically (e.g. Internet sites and tablet/smartphone applications) or by telephone or through the sales network affiliated with the sales circuits. A complimentary ticket or accreditation (usually nominative) issued by Cave del Duca is also considered an Admission Ticket.

8.2.2

The security personnel in charge of the entrances are authorised to carry out checks and not to allow the entry to the Event Venue of forbidden objects or those objects that they deem unsuitable or potentially dangerous, without prejudice to the possibility of the Police officers to carry out personal searches in accordance with the law.

8.2.3

Prohibited objects shall be placed outside the Event Venue, with no obligation of custody incumbent on Cave del Duca.

8.2.4

If the above prohibition is contested, the security personnel may refuse entry and remove the Spectator from the Event Venue. In this case, no reimbursement and/or compensation shall be due to the Spectator who has been turned away and has not attended the Event.

8.3 - Can animals attend the event?

8.3.1

Access to the Event Venue and participation in the Event are not permitted to animals of any kind, species or breed (except for guide dogs only).

8.4 - What time is the entrance to the venue?

8.4.1

Unless otherwise stated, theatres open to the public 60 minutes before the beginning of the Event, arenas at least 90 minutes before the beginning of the Event and stadiums at least 180 minutes before the beginning of the Event. Whenever possible, the opening time of the gates is indicated on the website and of the authorised ticketing circuit on the page dedicated to the Event and is sometimes also announced by the main media.

8.4.2

For technical-organisational reasons, the opening time of the gates may be changed by the Cave del Duca at any time and without prior notice, compared to the time originally scheduled and/or already announced or brought forward for reasons of public order.

8.5 - Does the Organiser guarantee a cloakroom service during the Event?

8.5.1

The cloakroom service can only be offered for certain types of Events, as a rule, for Shows in the Theatres, but Cave del Duca cannot provide guarantees on the operation of the cloakroom for all its Events. The presence of such free or paid service will be indicated from time to time in the Event info.

8.5.2

For Events where television filming is foreseen, a cloakroom service is generally provided, and it is the specific obligation of the spectator to use it.

9.1 - Is video filming/recording also carried out at the Event Venue?

9.1.1

At an Event, within or in the immediate vicinity of each venue, Spectators may be filmed, photographed and/or filmed and said images and audio footage may be broadcast live or deferred on television and/or on big screens within the venue and/or used to produce promotional and/or commercial material relating to the event and/or the artists.

9.1.2

By purchasing a ticket (including a ticket received as a gift) and in any case by entering the venue, the spectator gives his or her consent, free of charge and with the right to transfer this right to third parties, to be photographed, filmed or recorded and to the consequent diffusion of his or her image for reproduction on television and/or on the maxi-screens inside the venue and for inclusion in the promotional and/or commercial materials mentioned above.

9.1.3

The consent as expressed above shall be deemed to be given also with reference to minors, by their parents or adults exercising parental authority over them, at the time they purchase the ticket and, in any case, when accompanying minors inside the venue to attend the Event.

9.2 - What rules apply to an Event with audio/video filming or live television coverage?

9.2.1

In the case of Events that are subject to television filming, a specific entrance time to the Event Venue may be set by Cave del Duca for audio-video filming requirements. Cave del Duca reserves the right to prevent Spectators from entering the Venue if they arrive later than the time indicated on the ticket or admission ticket.

9.2.2

In view of the audio-visual filming that will be carried out during the Event, Spectators will not be allowed to leave the hall before the end of the Event.

9.2.3

For audio-visual and "eye-catching" filming requirements, Cave del Duca reserves the right to reallocate and move seats. In cases where a specific entry time has been set and the spectator arrives late, if admitted to enter, he/she may be placed in a seat other than the one indicated on the ticket, which has already been allocated to a third party for audience shifts decided by Cave del Duca.

9.2.4

During the Event and, above all, in the event of television filming, the Spectator is required to behave in accordance with the rules of good manners and in line with the requirements of audio-visual filming. Cave del Duca reserves the right, at its discretion, to expel from the hall any Spectator whose behaviour is deemed inappropriate or otherwise in conflict with the requirements of TV filming (e.g. use of mobile phone in the hall).

9.3 - Can the Spectator make video recordings or recordings of the Event?

9.3.1

Within the venue it is not permitted to make recordings, photographs, audio-video recordings in whole or in part of the Event, nor is it permitted to disseminate or make visible via the Internet any images and sounds that may have been recorded with any equipment, including smartphones.

10.1 - Can the Spectator make objections or requests related to the Event?

10.1.1

Complaints relating to the seat or any other dispute relating to the Event shall not be taken into consideration and shall not entitle to any reimbursement/compensation/damages, if raised after the Event has taken place by the Spectator who has nevertheless attended the Event. In addition, any dispute/request relating to the Event shall be examined and acknowledged by the Organiser only upon verification of the regularity of the Ticket purchased for the Event that is the subject of the dispute/request, which the Spectator shall be required to submit.

10.1.2

The Spectator is obliged to notify the staff appointed by the Organiser of any reasons for dispute concerning the seat purchased, strictly within the starting time of the Event.

10.2 - The view from my seat is obstructed or otherwise not optimal; I am not seated comfortably, am I allowed to change seats before the start of the Event?

10.2.1

The Spectator is obliged to occupy the seat expressly indicated on the ticket, however, the Organiser, at its discretion, may consider any requests for seat replacement under the following conditions:

  • concrete possibility of placing the spectator elsewhere (there must be free seats in the venue);
  • the request for a change of place must be based on serious reasons, which must be reported to the organiser, who will assess them at his sole discretion;
  • the request for a seat change, motivated as above, must reach the Organiser (by contacting the personnel in charge at the venue, the central ticket office and/or, if present, the info point), strictly within the starting time of the Event.

10.2.2

Failure to accept the request to move the seat, when the Event has nevertheless been enjoyed, does not entitle the Spectator to obtain a refund of the ticket price (see point 10) or other sums by way of compensation or indemnity. However, the Spectator who has purchased a double seat (the same seat also sold to others) and who for objective impossibility cannot be relocated to another seat, if he/she renounces the Event and leaves the venue before the concert begins, may obtain a refund of the ticket price (documenting the renunciation of the Event and the failure to use it).

10.2.3

Failure to promptly (10.2.1 - 3.) notify the Organiser of problems related to the location of the seat (e.g. poor visibility due to the presence of obstacles) with a request to move the seat, when the Event has been attended in any case, constitutes grounds for refusing the Spectator any and all requests for reimbursement of the ticket price or any other request made by way of compensation or for any other reason.

10.3 - In any event, 15 days after the Event date, the Spectator is precluded from any dispute or claim for indemnity/compensation relating to the Event.

10.4 - Requests for reimbursement or requests relating to shipments, orders and their cancellations must be addressed to the relevant sales outlet call centre.

Definitions

Event:

It is the event, show, indoor/outdoor performance to which the bearer of a valid Admission Ticket is entitled to access. When, during the event, show or performance, several artists are scheduled to perform in the context of the same Event, it is referred to as a festival.

Spectator:

The bearer of the Admission Ticket is the person holding a valid Admission Ticket, legitimately purchased from an authorised sales network (see 2.2.1) or received by Cave del Duca in the form of a credit. The Spectator must scrupulously comply with the Terms and Conditions of this Manual.

Entrance ticket/ticket:

This is the document, also in digital format, issued by the sales circuit (e.g. TicketOne), which legitimises the Spectator's access to the Event Venue. The purchase of the Entrance Ticket can be made electronically (e.g. websites and tablet/smartphone applications) or by telephone or through the sales network affiliated with the sales circuits (e.g. TicketOne). A complimentary ticket or accreditation (usually nominative) issued by Cave del Duca is also considered an Entrance Ticket.

Event venue/venue:

This is the set of buildings and grounds that constitute the venues for a specific Event (e.g. arena, stadium, theatre, club or any other outdoor or indoor venue where the event takes place).

Concert area:

This is the space inside the venue, where the stage is positioned, around which the spectators are positioned.

Single seat/Not numbered seat:

This is the type of Admission Ticket that guarantees the Spectator access to the Event from an area inside the venue (Concert Area), in which seats - seated or standing - are not assigned/reserved to the Spectator. Within such area, the Spectator is free to attend the Event by positioning him/herself according to the priority of arrival.
